Animal Welfare Bill (proposal) 2012 – your chance to speak up!!

Dear all,

Here is your chance to speak up before this new bill is tabled in Parliament.

    Done my part and helped all my family do their survey too. Have been publisicing it on my FB and send many private messages and sharing in FB. Hopefully we make an impact this time. It sound promising this time.

    MOST unfortunate that I cannot vote since I am no longer a Malaysian. BUT I am sending the link to my family and school friends and encourage them to vote for the animals in Malaysia.

    WE need to build a GIANT snowball of voters for the animals in Malaysia!

    Done!. How awesome is the Penalties for offences under the proposed bill

    Briefly, grouping the offences under 3 categories from general offences to serious offences,

    (1) Any person convicted of a Serious offence shall be liable on conviction to—

    (a) a fine not exceeding RM 50,000.00 but not less than RM5,000.00,or
    (b) an imprisonment for a term not exceeding three years , or to both.

    (2) Any person convicted of an Intermediate offence shall be liable on conviction to—

    (a) a fine not exceeding RM 30,000.00 but not less than RM 3,000.00, or
    (b) Imprisonment for a term not exceeding two years, or to both

    (3) Any person convicted of a General offence shall be liable on conviction to—

    (a) a fine not exceeding RM 20,000.00 but not less than RM 2,000.00, or
    (b) Imprisonment for a term not exceeding one year, or to both

      For the last question in the survey about the penalties, i’m not satisfied with the limit of the fine and period of imprisonment.
      it should start at a higher amount and how actually do they classified the offences categories?
      it needs to be more details.

    Cruelty offences

    Any person who-

    cruelly beats, kicks, over-rides, over-drives, over-loads, tortures or terrifies any animals; or
    causes or procures, or being the owner, permits any animal to be so used; or
    Being in charge of any animal in confinement or in course of transport from ane place to another neglects to supply such animal with sufficient food or water; or
    By wantonly or unreasonably doing or omitting to do any act, causes any unnecessary pain or suffering, or, being the owner, permits any unnecessary pain or suffering to any animal; or
    Causes, procures or , being the owner, permits to be confined, conveyed, lifted or carried any animal in such manner or position as to subject it to unnecessary pain or suffering; or
    employs or causes or procures or being the owner permits to be employed at any work labor, any animal which in consequence of any disease, infirmty, wound or sore, or otherwise is unfit to be so employed; or (animal act 44, (1)(f)).
    keeps or confines any animal in any cage or other receptacle which does not measure sufficiently in height, length and width to permit the animal a reasonable opportunity for its natural movement; or
    keeps any animal chained or tethered with a short or heavy chain or cord, or hobbles the legs of animal; or
    being the owner of any animal fails to provide such animal with sufficient food, drink or shelter; or
    abandons any animal in circumstances which render it likely that it will suffer trauma, pain or suffering by reason of relocation, starvation, thirst, injury, or illness; or
    willfully or negligently permits any animal, of which he is the owner, to go out unattended in any place while the animal is infected with contagious or infectious disease or, permits any diseased or disabled or injured animal, of which he is the owner, to die in any place; or
    offers for sale or without reasonable cause, has in his possession any animal which is suffering in pain by reason of mutilation, starvation, thirst, overcrowding or other ill treatment; or
    mutilates an animal in any manner including ear cropping, tail docking, defanging, declawing, branding, piercing or kills any animal in any manner other than as prescribed; or
    causes, procures or assists at fighting or baiting of any animal, or keeps, uses, manages, or acts or assists in management of any premises or place for the purpose , of fighting or baiting any animal, or permits any premises or place to be so kept, manage, or used, or receives or causes or procures any person to receive , money for the admission of any person to such premises or place; or (animal act 44, (1)(g)).
    promotes or takes part in any shooting match or competition wherein animals are released from captivity for the purpose of such shooting; or
    organizers, participates, promotes or in any manner is associated with any sport or activity involving the use of animals, where such animals are subjected to cruelty either during the sport or activity itself, or while in training; or
    skins or roasts or kills for superstition or extracts parts of any live animals through a procedure which causes pain and suffering, for the purpose of getting skins, oils or other animal products; and
    dynamites or electrifies or poisons any streams or rivers or other water bodies to kill, harvest or catch animals;

    shall be guilty of an offence of cruelty.

    I think they must add: Illegal organizations/ group/ cults/ individuals who kills or torture animals or any procedure which causes pain and suffering for the sake of sacrificial ceremonies, prayers, offerings, superstitious beliefs shall be guilty of an offence of cruelty.

    One of the set back of this survey is the comments column. They limit the number of characters. I have a lot to say and so little space allowed to type.
    And i also put a comment on YB Chua Tee Yong’s FB that the survey were not publicise widely for the public to know. It should have a wide coverage and awareness so that more people knows about it in order to garner more surveys. Anyway, we shall do the best that we know how to encourage people around us to take this survey.

    I have been picking up and adopting stray cats, rescued from traffic lights, from kopitiams and along SS2 since 2004. Sometimes, I pick up mama cats who are heavily pregnant because I simply don’t have the heart to leave them behind! Once I saw them and I knew I had to do something and the intention to desex them after the kittens are old enough to nibble solid food with the helps of my Vet’s wife. The friendly and clever ones are lucky because I can reach out to them. I will bring them to my Vet and wife, who are very good with pets. I know it is not only out of money that they love pets! I know for sure that the cats which I brought to them are in Good Hands. You can tell that they truly have the hearts for pets. By doing so, my cat numbers have multiply over the years, I now have 11 cats, all desexed, staying in door and 3 strays staying outdoor and they are allowed to come in whenever I am around. They are now part of the family. I also have more than 25 cats as long term residents in the vet’s clinic. To have cats and dogs are life time commitment, well for at least 15 to 20 years. They are just like you and I, when you fall sick, you need medication etc… Very often, I heard stories of parents who bought pets for their children, simply because the children said they want it and because it is cute!! I wish these parents will think twice and at least explain to their children that a pet is like a member of the family, it needs attention, pampering and respect them and every other things that you can think of. I totally dislike homespun breeders who have no respect for their pets, all they want is to get rid off the pups and kittens barely 2 months’ old with interesting income?? How cruel, these young pups and kittens still need mother’s milk and grooming. You can witness some kittens in pet shops only a month’s old, they look weak and little knowledge of grooming themselves and you can see their bottom are covered with poo! I will never ever buy any cat or dog from pet shops. I can always adopt one from PAWS and SPCA. I strongly believe that there must be a better Legislation for genuine breeders and another issue is how to EDUCATE adults and children in keeping pets like cats and dogs. 9 out of 10 keep dogs for unreasonable reasons and I wish the Animal Protection Laws impose stiffer fine for those who abuse dogs and cats.

    Hi Wong Yoke Mei! I also have the same complain about the comments section. Can only type so few lines! And no section in the form to feedback about the survey. I was looking for a comment section at the end to enter more general thoughts and opinions other than what I’ve commented below the questions, but it does not have any space for us to comment more. It kind of ended abruptly. Can AnimalCare send this link to YB Datuk Chua after readers have added their long comments here that can’t fit into the survey form?
